What we do
Trade mark registration and brand protection services in India
Trade Mark Consultation and Registrability Assessment
The proposed trade mark is assessed for distinctiveness, legal eligibility and potential registration risks. A tailored filing strategy helps businesses make informed decisions and establish a strong foundation for brand protection in India.
Trade Mark Search and Availability Report
A comprehensive search of the Indian Trade Marks Registry identifies identical or similar registered marks and pending applications. The search report and legal risk assessment help minimise potential conflicts and support informed registration decisions.
Trade Mark Classification and Application Preparation
Applicant details, appropriate trade mark classes and specifications of goods or services are carefully reviewed. Accurate classification and drafting align the scope of protection with the business's commercial objectives.
Trade Mark Application Filing in India
The application is prepared and filed online with the Indian Trade Marks Registry on Form TM-A, with the prescribed documents and fees. The application number and filing acknowledgement establish the official record for tracking and prosecution.
Trade Mark Application Monitoring and Compliance
The application is monitored for Registry updates, procedural requirements and outstanding deficiencies. Timely compliance helps reduce avoidable delays and the risk of abandonment.
Trade Mark Examination and Objection Reply
Examination reports issued by the Trade Marks Registry are analysed, and objections under the Trade Marks Act, 1999 are addressed through reasoned legal submissions and supporting evidence, advancing the application towards acceptance.
Trade Mark Hearing and Legal Representation
Where required, legal arguments and supporting documents are prepared, and representation is undertaken before the Registrar to address examination objections and support the registration process.
Trade Mark Journal Publication
Following acceptance, the trade mark is published in the Trade Marks Journal for public inspection and potential opposition. Publication details and the statutory opposition period are monitored to identify third-party challenges in time.
Trade Mark Opposition and Legal Defence
Where a third party opposes the application, legal representation is provided through counter-statements, evidence, written submissions and hearings, as applicable, protecting the applicant's commercial interests and advancing the application towards registration.
Trade Mark Registration Certificate and Verification
On completion of the registration process, the registration certificate and relevant particulars are verified and provided, confirming registered ownership and the applicable renewal requirements.
Post-Registration Protection and Renewal
Ongoing services include renewal management, portfolio maintenance, monitoring of potentially conflicting marks and infringement-related legal guidance, helping maintain trade mark rights and protect long-term brand value.
Well-Known Trade Mark Recognition in India
Legal assistance is provided for seeking recognition of a well-known trade mark under the Trade Marks Act, 1999, including assessing brand reputation, compiling evidence of recognition and commercial use, and filing the application on Form TM-M. Recognition can extend protection against conflicting marks across different goods and services, subject to statutory requirements and the Registrar's decision.
Our approach
How a matter progresses
The usual course of a trade marks matter in India, from first instructions to a final outcome.
Clearance search
We search the Trade Marks Registry and the market for earlier conflicting marks and give a written view on risk before you adopt the mark.
Filing
We file in the correct classes of the Nice Classification, claiming use from the right date or on a proposed-to-be-used basis.
Examination
If the Registry raises objections, we reply to the examination report within 30 days and appear at any show-cause hearing.
Advertisement and opposition
The accepted mark is advertised in the Trade Marks Journal. Third parties have four months to oppose, and we answer any opposition with a counter-statement.
Registration and renewal
Once registered, the mark is protected for ten years at a time. We watch the Journal for conflicting filings and renew the registration on time.
